We discuss how the Arab Spring is a reflection of the resiliency of the human rights regime. In order to accomplish this, we explore the extent to which the Arab Spring represents norm diffusion among Middle East and North Africa states. Specifically, we examine the cases of Tunisia, Egypt, and Bahrain and consider how economic and demographic changes created space for human rights discourse in these countries. We find that, in the case of MENA states, the Arab Spring represents significant (...) pressure from below. Access to new forms of social media allowed civil society to organize, publicize, and protest relatively efficiently. Social media expanded the potential role of individuals and created newly empowered latent human rights activists who emerged as leaders of the norm diffusion process. The resulting diffusion of human rights norms in the Arab region represents one of the most significant expansions of the human rights regime since the regime’s inception. (shrink)

We argue that the post-9/11 environment has amounted to a substantive change in the longstanding United States relationship with the international human rights regime. We identify three distinct phases of that relationship, noting that in the most recent phase, since 9/11, the US has moved from passive support of the international human rights regime to a direct attack of that regime. Realist and liberal regime theories suggest that the human rights regime is relatively weak, and is unlikely to withstand such (...) an attack. We find that the regime has not only continued to persist, but has flourished even as US support has faltered. The human rights regime is surprisingly strong. We argue it is the ideological nature of the regime that explains its resilience, which suggests that constructivist theory is necessary to fully understand the human rights regime. (shrink)

Robert Burton's The Anatomy of Melancholy is one of the last great works of English prose to have remained unedited. The present volume inaugurates an authoritative edition of the work, which is being prepared by scholars on both sides of the Atlantic. It will be followed by two further volumes of text with textual apparatus, and two volumes of commentary. Burton concentrated a lifetime of inquiry into the Anatomy, describing and analysing melancholy and its causes - devoting especial attention to (...) love and religion - and recording possible cures. Primarily a scholarly study of morbid psychology, it is also a compendium of curious facts and anecdotes, and combines seriousness of purpose with a marked satirical vein. First published in 1621, it was a great success: four more editions were published in Burton's lifetime, in each of which new material was added, and a sixth, containing his final revisions, was published in in 1651, eleven years after his death. The textual complexity and Burton's extraordinary range of reference have hitherto deterred editors: this is the first scholarly edition to appear. In many animals, early development of the embryo is characterized by synchronous, biphasic cell divisions. These cell divisions are controlled by maternally inherited proteins and RNAs. A critical question in developmental biology is how the embryo transitions to a later pattern of asynchronous cell divisions and transfers the prior maternal control of development to the zygotic genome. The most‐common model regarding how this transition from maternal to zygotic control is regulated posits that this is a consequence of the limitation of (...) maternal gene products, due to their titration during early cell divisions. Here we discuss a recent article by Crest et al.1 that instead proposes that the balance of Cyclin‐dependent Kinase 1 and Cyclin B (Cdk1‐CycB) activity relative to that of the Drosophila checkpoint kinase Chk1 determines when asynchronous divisions begin. These essays use particular issues, thinkers and texts to engage the question of God in early Christianity.

Formalised knowledge systems, including universities and research institutes, are important for contemporary societies. They are, however, also arguably failing humanity when their impact is measured against the level of progress being made in stimulating the societal changes needed to address challenges like climate change. In this research we used a novel futures-oriented and participatory approach that asked what future envisioned knowledge systems might need to look like and how we might get there. Findings suggest that envisioned future systems will need (...) to be much more collaborative, open, diverse, egalitarian, and able to work with values and systemic issues. They will also need to go beyond producing knowledge about our world to generating wisdom about how to act within it. To get to envisioned systems we will need to rapidly scale methodological innovations, connect innovators, and creatively accelerate learning about working with intractable challenges. We will also need to create new funding schemes, a global knowledge commons, and challenge deeply held assumptions. To genuinely be a creative force in supporting longevity of human and non-human life on our planet, the shift in knowledge systems will probably need to be at the scale of the enlightenment and speed of the scientific and technological revolution accompanying the second World War. This will require bold and strategic action from governments, scientists, civic society and sustained transformational intent. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:242 HISTORY OF PHILOSOPHY his political and religious predispositions prodded him to demonstrate that the roots of modern science were in the Christian Middle Ages. Sarton's particular foibles are best understood by referring them to his pacifist commitments and the moralistic assumption that the values of science are transferable to other human endeavors. Categories such as inductivism, conventionalism and Popperianism are of little help in gaining historical understanding. For (...) this, they are in fact Platonic ideals which have little heuristic value. I would venture that a truly historical historiography of science would aid us in spotting errors in the past and help us in the future. My guess is that a good analysis would reveal a major source of trouble to have stemmed from preconceived notions which the history of science was meant to illustrate. Surely some of them have been philosophical in character, and even Baconian or conventionalist. But until recent times, most of these preconceptions have stemmed from religious, nationalistic, or personal motivations, or from scientists who wanted support for a particular concept. I agree with Agassi only in the suggestion that a parti pris was at the root of our troubles. Why, then, substitute a Popperian preconception for a conventionalist one? Why not, on the contrary, combat their distorting influence and reduce their impact? This is in fact what has happened in recent times. As the history of science has fallen into the hands of a gradually organized profession, the blatant motivations --of any type--which colored past historical writings have slowly receded. By a constant and critical confrontation of opposing views among specialists, the purpose for examining the history of science has slowly been transformed. The older external motivations have given way to an interest in the subject for its own sake and a gradual transformation has been in the making for the last few decades. As happens in other human endeavors, professionalization has already raised the standards in the discipline and there is every reason to think it will continue to do so in the future. RAID-II is a high-bandwidth, network-attached storage server designed and implemented at the University of California at Berkeley. In this paper, we measure the performance of RAID-II and evaluate various architectural decisions made during the design process. We first measure the end-to-end performance of the system to be approximately 20 MB/s for both disk array reads and writes. We then perform a bottleneck analysis by examining the performance of each individual subsystem and conclude that the disk subsystem limits performance. By adding (...) a custom interconnect board with a high-speed memory and bus system and parity engine, we are able to achieve a performance speedup of 8 to 15 over a comparative system using only off-the-shelf hardware. This chapter discusses the theory of international law. In analytic jurisprudence, at least since the latter half of the twentieth century, the primary debate in general jurisprudence has been between legal positivism and its most ardent critic, Ronald Dworkin. The positivist tradition is represented here by its two most important theorists, Hans Kelsen and H.L.A. Hart. During their careers, Kelsen and Hart clashed over the best understanding of legal positivism. For his part, Dworkin devoted the bulk of his critical attention (...) to Hart's work. The chapter also focuses on the way in which each theorist builds his view of international law against the background of a more general jurisprudence. Hart argues that the differences between international law and municipal law might eventually be overcome. International law might be in a stage of transition that will bring it nearer in structure to a municipal system. (shrink)

Ronald Dworkin famously argued that legal positivism is a defective account of law because it has no account of Theoretical Disagreement. In this article I argue that legal positivism—as advanced by H.L.A. Hart—does not need an account of Theoretical Disagreement. Legal positivism does, however, need a plausible account of interpretation in law. I provide such an account in this article.

In a recent comment on H.L.A. Hart’s ‘Postscript’ to The Concept of Law, Ronald Dworkin claims that the meaning of legal and political concepts may be understood by analogy to the meaning of natural kind concepts like ‘tiger’, ‘gold’ and ‘water’. This article questions the efficacy of Dworkin’s claims by challenging the use of natural kinds as the basis for a semantic theory of legal and political concepts. Additionally, in matters of value there is no methodological equivalent to the scientific (...) method. Thus, there is little hope of finding hidden essences to explain the meaning of legal and political concepts. Finally, even if there are natural kinds, Dworkin’s arguments for their efficacy in jurisprudence are problematic and unpersuasive. The problem for Dworkin is that his embrace of natural kinds undermines the ‘fit’ side of the fit/justification model of adjudication that lies at the heart of his theory of law. (shrink)

Partly due to the influence of Tarski's work, it is commonly assumed that any good theory of truth implies biconditionals of the sort mentioned in Convention T: instances of the T-Schema "s is true in L if and only if p" where the sentence substituted for "p" is equivalent in meaning to s. I argue that we must take care to distinguish the claim that implying such instances is sufficient for adequacy in an account of truth from the claim that (...) doing so is necessary. The claim that doing so is sufficient is a common component of deflationary theories of truth, while the claim that it is necessary, though often assumed, must be denied by proponents of rival inflationary theories of truth. I discuss the clarification of the debate between these views of truth that results from distinguishing the necessity and the sufficiency claims, and examine the prospects for its resolution. In this dissertation I argue that the concept of a moral right is best explicated by means of the concept of morally legitimate coercion. This thesis, which I call the enforceability thesis, says that to have a right is to have a claim such that one would be justified in pursuing a course of action up to and including harm should the claim be dissatisfied. I contend that this thesis, if it is true, explains much about our intuitions concerning moral (...) rights, accounts for the historical importance of rights-talk in the context of events such as revolutions and political reforms, and explains why rights are a necessary part of the moral vocabulary. If rights do not set out conditions under which coercion is morally appropriate, then they do nothing that other moral concepts could not do. ;Drawing on the work of H. L. A. Hart, John Rawls, and others, I argue that the philosophical strength and practical efficacy of rights on the enforceability thesis is best realized when rights are treated as action-guiding principles set within a framework of moral decision making under reflective equilibrium. Using the process of reflective equilibrium as a backdrop, I argue that rights can have sufficient normative force to play an important role in moral and political theory without being either impracticably stringent or subject to so many exceptions that they lose their efficacy. ;With this background in place I next set out and argue for a view of human rights which, because human rights turn out to be best understood as rights to primary goods, I call the theory of primary rights. The account I give of primary rights emphasizes their justificatory place in arguments for coercion, their importance to the moral integrity of the individual, and the practical applicability of the overarching theory of rights developed in this dissertation. Using an intersectionalist analysis, Hinther recounts efforts by Canada’s Ukrainian minority to build an ethnically distinct leftist movement. Opposed from without by both left-wing internationalists and right-wing nationalists, and hobbled from within by stubborn gender and generational inequalities, the movement finally lost its radical political momentum and so took up its allotted place in Canada’s polite multicultural mosaic. Contrary to Vaesen's argument that humans are unique with respect to nine cognitive capacities essential for tool use, we suggest that although such cognitive processes contribute to variation in tool use, it does not follow that these capacities arenecessaryfor tool use, nor that tool use shaped cognition per se, given the available data in cognitive neuroscience and behavioral biology.

The authors explore the changing dynamics of gendered familial caregiving in urban China within the context of economic reforms and the continued cultural influence of xiao. Data collected in China through interviews with 110 familial caregivers were used to examine cultural and structural influences on the caregiving behavior of adult children. Results from multiple regression analyses provide evidence of a gendered division of parental care tasks, a decline in the patrilocal tradition of caregiving, and a strong social pressure that influences (...) caregiving behavior. Structural factors linked to caregiving performance included family size, lack of pensions for elders, and caregivers’ employment status and income. Findings portend deleterious effects for the women who are now caregivers as they are likely to live longer but be more financially dependent and have fewer children available to help them. (shrink)
